1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of pathfinderscrumb.com and any website content, community feature, product, service, order method, or digital material offered by Pathfinder’s Crumb (“Pathfinder’s Crumb,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Our Privacy Policy explains how information is handled.
2. What the Site Provides
The Site may include:
Books, chapters, excerpts, lore, characters, settings, artwork, music, videos, and other creative content;
Information about Pathfinder’s Crumb, N.W. Pathling, Pathling Press, and related projects;
Links to books or products sold by third-party retailers;
Bakery announcements, menus, product descriptions, pickup details, and future ordering options;
Community links, discussion information, reviews, and reader resources; and
Other information, downloads, events, or services that may be added later.
Features, products, chapters, menus, prices, and availability may change.
The appearance of a product or service on the Site does not guarantee that it is currently available. Unless an ordering method is active and you receive an order confirmation, website content is not an accepted order or binding promise to provide a product.
3. Eligibility
People of different ages may read publicly available stories and general website content.
You must be at least 18 years old and legally capable of entering a contract to:
Place an order;
Submit payment;
Enter a legally binding promotion;
Grant rights in submitted content; or
Make another binding agreement with Pathfinder’s Crumb.
A parent or legal guardian must complete transactions for a minor.
4. Permitted Use
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for personal, lawful, noncommercial purposes.
You may:
Read publicly available stories and lore;
Listen to authorized music or audio;
Share links to public pages;
Quote brief portions for commentary, review, education, or discussion when legally permitted and properly attributed;
Download material that is expressly offered for personal download; and
Contact us about products, orders, collaborations, permissions, or services.
You may not:
Use the Site for unlawful, fraudulent, abusive, or harmful purposes;
Circumvent access controls or security features;
Interfere with the Site, its hosting, embedded services, or other users;
Introduce malicious code or attempt unauthorized access;
Copy or distribute substantial portions of books, chapters, artwork, music, downloads, or other content without permission;
Repost full chapters or paid materials elsewhere;
Sell, sublicense, or commercially exploit Site content without written permission;
Falsely suggest that you represent, partner with, or are endorsed by Pathfinder’s Crumb;
Remove copyright, trademark, attribution, or rights notices;
Scrape, crawl, archive, or systematically extract substantial Site content without permission;
Use Site content, books, artwork, music, characters, or other materials to train, develop, evaluate, or improve an artificial-intelligence or machine-learning system without prior written permission; or
Use the Site in a way that infringes another person’s rights.
5. Intellectual Property
The original creative expression appearing on the Site—including books, chapters, prose, dialogue, illustrations, photographs, music, recordings, videos, graphics, downloadable files, and the creative selection and arrangement of content—is owned by or licensed to Pathfinder’s Crumb, N.W. Pathling, Pathling Press, or the identified rights holder.
Copyright protects the original expression contained in those works. Copyright does not necessarily protect an underlying idea, concept, system, name, title, short phrase, or mere list of recipe ingredients.
Names, logos, source-identifying phrases, trade dress, and branding may be protected under trademark, unfair-competition, or other applicable law whether or not a formal registration symbol appears.
Recipes may contain protected written expression, photography, design, or confidential business information even when a basic ingredient list or cooking method is not independently protected by copyright.
No ownership rights are transferred to you by allowing you to access the Site.
Contact us through the Contact page for licensing, adaptation, performance, reproduction, commercial-use, or collaboration requests.
6. Books and Third-Party Retailers
Books or merchandise may be offered through Amazon or another third-party retailer.
A purchase completed on a third-party retailer’s website is governed by that retailer’s:
Ordering procedures;
Payment terms;
Shipping policies;
Return and refund rules;
Privacy practices; and
Customer-service procedures.
Pathfinder’s Crumb is not responsible for a third-party retailer’s website operation, shipping performance, account security, or independent policies.
7. Bakery Orders
This section applies whenever Pathfinder’s Crumb begins accepting bakery orders through the Site, a linked form, email, invoice, payment link, social-media message, or another authorized ordering method.
Order Requests and Acceptance
An inquiry, form submission, or message is a request and does not guarantee availability.
An order becomes accepted only when Pathfinder’s Crumb confirms the product, quantity, price, pickup or delivery details, and any required payment or deposit.
We may decline, limit, or cancel a request because of:
Capacity or ingredient limitations;
Scheduling conflicts;
Product availability;
Safety concerns;
Incorrect pricing or descriptions;
Suspected fraud;
Failure to provide required information or payment; or
Circumstances outside our reasonable control.
If we cancel an accepted prepaid order and no substitute is agreed upon, we will refund the amount paid for the canceled item.
Prices and Payment
Prices are stated in U.S. dollars unless otherwise indicated.
Taxes, platform fees, delivery charges, deposits, or other disclosed charges may apply. Prices may change before an order is accepted.
You represent that you are authorized to use the payment method submitted.
Customization and Substitutions
Product photographs are examples. Handmade products naturally vary in shape, color, appearance, texture, and decoration.
Minor ingredient, packaging, or decorative substitutions may be made when reasonably necessary, provided they do not knowingly contradict an accepted material specification or disclosed allergen requirement.
We will attempt to contact you before making a substantial change.
Cancellations, Changes, and Refunds
The cancellation or modification deadline provided with an order controls.
Because bakery products are perishable and may be prepared specifically for an order:
An order may become nonrefundable once ingredients have been specially purchased or production has begun;
A deposit may be nonrefundable when disclosed before payment;
Completed perishable products generally cannot be returned for a change of mind;
Approved refunds may exclude nonrecoverable third-party processing fees when permitted by law and disclosed; and
A request to change quantity, flavor, pickup time, or customization is subject to availability and may change the price.
Nothing in this section removes rights that cannot lawfully be waived.
Pickup, Delivery, and No-Shows
Customers are responsible for providing accurate contact and pickup information and arriving within the agreed pickup period.
Once an order has been properly delivered or released to the customer or the customer’s authorized recipient, the customer is responsible for transportation, temperature control, storage, reheating, and service.
If an order is not collected:
We may attempt to contact the customer;
Food-safety limitations may prevent later pickup;
Perishable products may need to be discarded; and
Payment may remain nonrefundable when the order was completed as agreed.
Delivery, if offered, is limited to the area and terms stated with the order.
8. Ingredients, Allergens, and Dietary Requests
Food products may contain or come into contact with any of the nine major food allergens:
Milk;
Eggs;
Fish;
Crustacean shellfish;
Tree nuts;
Peanuts;
Wheat;
Soybeans; and
Sesame.
Products may be prepared in a shared commercial kitchen that handles multiple allergens. Pathfinder’s Crumb cannot guarantee that any product, equipment, preparation area, storage area, or packaging environment is completely free from allergen cross-contact.
Ingredient and allergen information provided with a specific product or on its label is more authoritative than general website descriptions.
Recipes, suppliers, and ingredients may change. Customers with an allergy, intolerance, religious restriction, medical condition, or other dietary concern should contact us before ordering and review the final product label before consumption.
A dietary request is not accepted unless it is expressly confirmed as part of the order. We may decline a request when we cannot safely or reliably accommodate it.
9. Food Storage and Customer Handling
Follow all storage, refrigeration, freezing, reheating, use-by, and handling instructions provided with the product.
Do not consume a product that appears spoiled, damaged, improperly stored, contaminated, or unsafe.
Pathfinder’s Crumb is not responsible for deterioration or contamination occurring after proper delivery or pickup because of delayed refrigeration, improper transportation, unsafe reheating, mishandling, or storage outside the provided instructions.
10. User Content
“User Content” means reviews, comments, photographs, testimonials, messages, artwork, or other material that you voluntarily submit for possible publication or community use.
You retain ownership of your User Content.
When you intentionally submit User Content for publication, promotion, a contest, or community display, you grant Pathfinder’s Crumb a nonexclusive, worldwide, royalty-free license to reproduce, format, display, distribute, and promote that content in connection with Pathfinder’s Crumb, its books, bakery, website, social media, and related business activities.
You represent that:
You own the content or have permission to submit it;
It does not infringe another person’s rights;
Any people visibly depicted have authorized the intended use where authorization is required;
It is not deceptive, unlawful, defamatory, threatening, harassing, obscene, or malicious; and
Any statements about your experience are truthful.
We may edit User Content for length, spelling, formatting, or clarity without materially changing its meaning. We may decline or remove content at our discretion.
You may ask us to stop using submitted content in future digital materials. This may not require us to recall printed materials, previously published posts, or materials already distributed.
11. Unsolicited Creative Submissions
Do not send unsolicited manuscripts, story proposals, character concepts, scripts, music, artwork, confidential ideas, or proprietary business concepts through general contact channels.
We do not agree to treat unsolicited submissions as confidential, and receiving a submission does not create a fiduciary, creative-development, publishing, employment, or compensation relationship.
Because Pathfinder’s Crumb continuously develops stories and products, independently developed material may resemble an unsolicited idea.
This section does not apply to material submitted through an expressly authorized contest, application, commission, collaboration, or submission process governed by separate written rules.
12. Community Conduct
When participating in a Pathfinder’s Crumb community space, you agree to:
Treat others with reasonable respect;
Mark significant story spoilers when appropriate;
Credit other people’s work;
Avoid harassment, threats, hate, impersonation, spam, and deliberate disruption;
Avoid publishing another person’s private information; and
Follow any additional rules of the platform hosting the community.
Third-party community spaces, including Discord or social-media platforms, are also governed by the platform’s own terms and moderation systems.
13. Creative, Fictional, and Faith-Related Content
The Pathling world, its characters, events, places, and lore are fictional unless expressly identified otherwise.
The stories may reflect or explore real themes involving belief, grief, community, morality, hardship, history, hope, or spirituality. They are not:
Historical records;
Scripture or religious doctrine;
Official teaching on behalf of a church or religious institution;
Professional counseling;
Medical, legal, financial, or mental-health advice; or
Instructions for making major personal decisions.
Readers may interpret creative work differently. Pathfinder’s Crumb does not guarantee a particular emotional, spiritual, or personal result.
14. Third-Party Links and Embedded Services
The Site may link to or embed content from third parties, including Google, Amazon, YouTube, Discord, Facebook, Instagram, payment providers, and other services.
We do not control and are not responsible for:
Their availability;
Their content;
Their collection of information;
Their security;
Their advertising;
Their transactions; or
Their terms and policies.
Use of a third-party service is governed by that provider’s rules.
15. Corrections and Availability
We make reasonable efforts to present accurate information, but typographical errors, outdated information, broken links, technical problems, pricing errors, story-continuity errors, or product-description errors may occur.
We may correct errors and update, remove, suspend, or discontinue content, products, or features without prior notice.
We do not guarantee uninterrupted access to the Site or permanent availability of free chapters, downloads, audio, or other content.
16. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.
We do not guarantee that:
The Site will always be uninterrupted, secure, or error-free;
Every link, download, embedded file, or feature will remain available;
All information will always be complete or current; or
Site content will meet every user’s expectations.
Nothing in these Terms excludes an express product promise that Pathfinder’s Crumb makes in writing as part of an accepted order.
17. Limitation of Liability
To the fullest extent permitted by law, Pathfinder’s Crumb and its owners, contributors, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site.
For a claim relating to a specific paid transaction, our total liability will not exceed the amount paid directly to Pathfinder’s Crumb for the product or service giving rise to that claim, except where applicable law requires otherwise.
These limitations do not exclude liability that cannot legally be excluded or limited, including liability arising from willful misconduct or another category that applicable law makes nonwaivable.
18. Indemnification
You agree to indemnify and hold Pathfinder’s Crumb harmless from third-party claims, losses, or reasonable expenses arising from:
Your unlawful use of the Site;
User Content you submit;
Your infringement of another person’s rights; or
Your material violation of these Terms.
This obligation does not apply to claims caused solely by Pathfinder’s Crumb’s own conduct.
19. Termination
We may restrict or terminate access to a nonpublic feature, account, download, or community function when reasonably necessary to protect the Site, enforce these Terms, comply with law, or address abusive conduct.
Provisions concerning intellectual property, submitted content, disclaimers, liability, indemnification, and dispute resolution survive termination when their nature requires it.
20. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any dispute not resolved informally may be brought in a North Carolina state or federal court that has lawful jurisdiction over the parties and the dispute.
Nothing in this section prevents a consumer from exercising a right or using a forum that applicable law does not permit these Terms to waive.
21. Severability
If part of these Terms is held invalid or unenforceable, that portion will be interpreted or limited to the minimum extent necessary, and the remaining portions will continue in effect.
22. No Waiver
Failure to enforce a provision of these Terms on one occasion does not waive the right to enforce it later.
23. Entire Agreement
These Terms, the Privacy Policy, any applicable Disclaimer, and any order-specific terms constitute the agreement governing use of the Site and the relevant transaction.
Order-specific written terms control over these general Terms when they directly conflict.
24. Changes to These Terms
We may revise these Terms when the Site, products, services, or legal requirements change.
Revisions will be identified by the “Last updated” date and will apply prospectively when posted unless another effective date is stated.
Material changes will not retroactively take away rights in a completed transaction unless permitted by law and expressly agreed.
